1.1 This is Bavet’s privacy policy. Our company details can be found in article 3 below.

This policy applies to the processing of your details by Bavet, which may or may not be available on our website at https://www.bavet.eu

With this policy, we try to inform you about this in a transparent way. We advise you to read this policy carefully. You can consult this policy at any time under the heading ‘Privacy Policy’ on our website.

Please note that this policy does not cover the privacy policies of third parties (e.g. the ordering platforms to which you are referred over our website) or of websites or applications referred to by hyperlinks on our website. The processing of your data by Deliveroo is governed by its privacy policy (https://deliveroo.be/nl-be/privacy). The same applies to Uber Eats: https://www.uber.com/legal/en/document/?name=privacy-notice&country=belgium&lang=nl.

1.3. We may change this privacy policy at any time. You should therefore consult it on a regular basis. The amended privacy policy will be published on our website.

1.4. This privacy policy is subject to Belgian law. Only the courts of Ghent (Ghent division(s)) have jurisdiction in case of disputes.

2. Who is responsible for processing your data?

We (Bavet) are. We are the so-called ‘data controller’ to use a difficult term. This means that we determine the purpose and means of processing and guarantee the lawful and correct processing of your data. Our Belgian entity (BV HEB) is responsible for the data processing with regard to our Belgian restaurants / pick-up points and delivery in Belgium. Our Dutch entity (BV NHEB) is responsible for the data processing with regard to our Dutch restaurants / pick-up points and delivery in the Netherlands. The companies that process your data through the ordering platforms are also responsible for the processing of your data.

4. What data do we process about you and how?

4.1. Bavet processes the following data:

– your personal identification details: surname, first name, address, telephone number, e-mail address;
– if you are a company: name of the company, registered office and company number;
– your financial details: bank account number and/or other payment details;
– electronic identification and location information when you visit our website: device information, browser, operating system, IP addresses, cookies, log file data, external websites that have referred you, pages you visited on the website (and date and time);
– personal characteristics if needed (e.g. for personalised cards with orders): e.g. age, date of birth and gender.

4.2. Bavet may receive your details either directly from you, e.g. because you provide them when ordering online on the website, or indirectly through third parties (e.g. through the ordering platforms such as Deliveroo, Uber Eats and Deliverect with which we collaborate).

Bavet may receive and process your personal data in the context of the contract with you, when you place an order or have a delivery carried out, when you contact Bavet for information (by telephone, in writing or through the website), or by cookies on our website.

Bavet may also receive your details from third parties, e.g. the ordering platforms (whether or not as data processor on behalf of Bavet) or affiliated companies of Bavet.

5. Why and on what basis do we process your data?

5.1. Bavet processes your personal data for the following purposes:

– Customer management:

We process your personal data in order to contact you, handle any questions you may have and provide you with the necessary information about our products (Bavet dishes), our services, special offers, discounts, our website or other information related to our activities.

We also process your personal data for the management of our customer records, the execution and follow-up of orders, deliveries, collections, payments, administration, invoicing and accounting.

We process your data in the context of the execution of the contract with you as our customer (i.e. selling our Bavet dishes and/or other products to you online or through our pick-up points).

The processing of your data for these purposes is necessary for the preparation and execution of the contract.

If you do not provide us with certain details, such as your identification details or financial details, which we require for the purposes of the contract, either directly or through the ordering platforms we work with, we will not be able to serve you, or process or execute your order(s).

We may process your data in order to optimise sales and our products and services. For example, Bavet may contact you to place a review on our website. This can be done on the basis of our legitimate interests.

– Direct marketing:

Your data may be used for direct marketing. This means sending information via our newsletter or other means about our products and services or other information that could be interesting or useful to you.

If you are a customer, this can be done on the basis of our legitimate interests. If you are not a customer, we need your prior consent (e.g. by registering on our website). Your consent is free and can be withdrawn at any time.

– Ensuring the optimal functioning of our website:

When you visit or consult the website, we may process certain electronic data, such as cookies and IP address (see article 4.1 above). Cookies facilitate interaction between you as a visitor and our website and are used to improve the user experience and to collect statistics among visitors to our website. Cookies also ensure that your personal settings and preferences are stored or that audio and video material can be played back. Certain cookies may be placed by a third party, e.g. Google Analytics, to measure the use of our website.

– The transfer to our partners, service providers (e.g. the ordering platforms such as Deliveroo, Uber Eats and Deliverect with which we collaborate), suppliers and/or other contracting parties of Bavet for the execution of the foregoing.

– Compliance with applicable laws.

5.2. The processing of your data, whether or not on or through the website, is not done for the purposes of ‘automated individual decision-making’ or profiling.

6. Who else receives or processes your data (besides Bavet)?

6.1. Your data are also primarily processed by our partners, service providers or suppliers in the context of the online sale of our products, such as the ordering platforms and delivery services (e.g. Deliveroo, Uber Eats and Deliverect) with which we collaborate. Furthermore, our website administrators, IT partners and network operators may also process your data in connection with your visit and use of our website. Companies that provide payment services, marketing services or analytical services to Bavet may also process your data in this context.

6.2. Finally, other companies may also process your data in the context of our activities, such as our bookkeepers, accountants, auditors, insurance brokers, insurance companies, legal advisors or other service providers.

6.3. We are not responsible for the processing of your data by third parties who do not do this on behalf of Bavet, but are themselves responsible for this (e.g. the ordering platforms we work with).

6.4. Bavet may be obliged to provide or process your details on the basis of a legal obligation incumbent upon it and/or in response to a request to this effect from supervisory authorities or government agencies.

7. How long do we keep your data?

7.1. We will not retain your data for longer than is necessary for the purposes described in article 5 above, unless special legal provisions apply to their retention or processing.

7.2. For example, we will retain your data for the purposes of online sales or sales through our collection points for a maximum of 10 years after the (last) order or delivery (this is the limitation period for contractual claims). Other time limits apply for certain other data. For example, we will keep certain social security documents relating to staff for five years and certain accounting and tax documents for seven years. We will retain data of job applicants for up to three years after their application, unless we need the data to defend ourselves against possible claims (e.g. concerning discrimination in the recruitment process) in which case we may keep the data for up to five years.

Certain other data may also be subject to specific legal retention periods. In any case, the principle applies here that we do not keep your data longer than necessary.

8. What are your rights?

8.1. You have the right to information about the processing of your data. This will be communicated to you in this privacy policy. You may also ask us to provide additional information at any time.

8.2. You have the right to ask us for:

– access to your data.
You can get one copy of the requested information free of charge. If you request additional copies, we may charge you a reasonable fee to cover the administrative cost.

– rectification of your data (if necessary);

– deletion of your personal data if:

– the processing of those data is no longer necessary for the purpose or purposes for which they were processed by us;

– you have withdrawn a previously given consent;

– you object to our processing;

– the personal data may have been processed unlawfully by us;

– this is necessary to comply with a legal obligation; or

– the personal data may have been processed in connection with the provision of online services to children.

– limitation of the processing that relates to you.
You have the right to obtain a limitation of the processing if:

– you dispute the accuracy of the data at our disposal;

– the processing is unlawful and you oppose the deletion of the personal data and instead request the restriction of their use;

– we no longer need those data whereas you still need them for the institution, exercise or substantiation of legal claims; or

– pending an answer to the question of whether Bavet’s legitimate grounds outweigh yours or your (privacy) rights if you have objected to the processing on the grounds of our legitimate interest.

8.3. You have the right to object to the processing of your data.

You may at any time and free of charge object to the processing of your data for direct marketing purposes. You can do this simply by letting us know at info@bavet.eu and/or by unsubscribing from our website. This can also be done through the mailings themselves (at the bottom there is always the option to unsubscribe). You will then no longer receive newsletters from us.

8.4. You have the right to portability of your data (to another data controller). This is only possible if the processing by us is based on your consent or if the processing is carried out using automated processes.

8.5. If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time.

8.7. The exercise of your rights as set out above is always subject to the requirements and conditions set out in the applicable law (such as the General Data Protection Regulation (the ‘GDPR’)).

8.8. To exercise your rights, you can simply send a request to Bavet at info@bavet.eu In doing so, you must identify yourself sufficiently. If we have reason to doubt your identity, we may ask you for additional information to confirm your identity. We will usually ask for a copy of your identity card to verify who is actually making a request.

1. Why this privacy policy?

1.1. This is the privacy policy of BV HEB and BV NHEB (“Bavet”), owner(s) and provider(s) of the mobile application ‘The Saucial Club’ (the app). Our company details can be found in section 3 below.

1.2. We attach great importance to your privacy and data protection. We therefore take all appropriate measures to protect your personal data in accordance with the applicable data protection legislation, including the General Data Protection Regulation (GDPR).

This privacy policy applies to the processing of your personal data by Bavet through the app. This document explains, among other things, which personal data we process, how, why and what rights you have in this respect, with whom your data can be shared etc. We try to inform you in a transparent way.

We advise you to read this privacy policy carefully. You can consult this policy at any time under the tab ‘Privacy Policy’ in the app.

1.3. This privacy policy does not cover any policies or terms of third parties nor of websites or applications referenced by hyperlinks in the app.

1.4. We may change this privacy policy at any time. Changes will be announced via the app or otherwise (e.g. via e-mail). The English text of this privacy policy will always prevail over any translations thereof.

4. What data do we process from you and how?

4.1. Bavet processes the following data in the context of using the app and our services:
– if you are an (end) user of the app:

o your personal identification data such as your name, first name, login data, account data, email address, postal code, Apple ID, Facebook I or Google ID (in particular when you register and create a profile on the app), promotional codes and other subscription and/or profile data;

o personal characteristics: age, gender, date of birth, family situation, number of children, eating habits, preferred meals, if You are vegetarian or not;

– If you are an organization, government or company (e.g. as a customer or licensee of Bavet): name of the organization(s), government(s) or company / companies, registered office(s), other addresses and company registration number(s) / VAT number(s);

– your electronic identification data in the context of the use of the app such as your device data, browser, operating system, IP addresses, cookies or similar technologies, log file data, login ID, user ID, passwords, external applications or websites, pages visited by you and/or functionalities used on the app (and date and time), statistics, ticket details, B-points, purchase behaviour etc.;

– personal data relating to your subscription on our newsletter (if applicable): email address, first and last name, log of acceptance of legal documents etc.;

– consumer service data (personal data that you choose to provide when you want to make comments or ask us a question, such as first and last name, email address, postal addresses, telephone number (optional), Bavet restaurant(s) visited, date and time of your visit, subject and content of your message, any remarks, messages, comments, communications, photos and other content that you post on or share through the app as an (end) user;

– location data if you have enabled the geolocation function on your device giving us permission for such processing: any data processed through the app that indicates your geographic location or position of your device and provided by the GPS system in order to identify the location of the (end) user’s device. Such location data will not be processed for longer than is required for and/or for purposes other than the purposes described below. You have the right to withdraw your consent to the processing of your location data at any time by disabling the geolocation function on your device. However, is it possible that this will affect the proper provision of your services and/or the effectiveness in relation to certain features that are based on your location, i.e. determining the nearest Bavet restaurant for your location;

– your financial data such as bank account number and/or other payment details (if necessary).
4.2. Bavet may receive your data directly from you, e.g. because you provide it through registration or login on the app or indirectly through third parties (e.g. other users or customers / licensees of Bavet).

Bavet may receive and process your personal data in the context of the (user) agreement with you, when you register or log in on app, when you use the app, when you contact Bavet (by telephone, in writing or via the app) or via cookies on the app.

Bavet may also consult your identification and/or contact details of external databases that we procure and combine these with the data that Bavet itself collects from you, in order to obtain more complete information.

4.3. Bavet does not collect or process any special categories of personal data about you, unless you would voluntarily provide it to us. Such special categories of personal data can be sensitive data, including information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, health or sexual life.

5. Why and on which basis do we process your data?

Bavet processes your personal data for:

5.1. Use of the app – providing its services – user management

We process your personal data in order to make our services available to you and providing access to the app, to create your account and profile, to manage our contractual relationship, including your participation in certain competitions, promotions or, if applicable, your membership in certain loyalty programs, to contact you, process your questions or complaints and provide you with the necessary information about our app, our services, Bavet restaurants, promotions, discounts, our website or other information related to our activities, to send you confirmation emails, push notifications, for back office or help desk purposes, payments, administration, billing, solvency tracking and accounting. We also process your personal data to verify whether your use of the app complies with our Terms of Use and the applicable legislation.
We process your data (or those of your company or organization) in the context of the preparation and/or execution of the agreement or on the basis of our legitimate (commercial) interests which, if appropriate, outweigh your (privacy) rights (as you can reasonably expect such processing).
If you do not provide us with certain information or data, such as your identification data or financial information, that we need as part of the agreement, we will not be able to provide our services or make the app available to you.
5.2. We may process your data to optimize the app and our services. We can process your personal data to monitor your use and access to the app and related services, analyse users’ habits, develop enhancements or new features to improve the app, optimize your navigation and user experience, and to conduct market research. To the extent possible, Bavet will process aggregated data (this is data that cannot identify you or be linked to you, such as statistical data), pseudonymised or anonymised data, rather than personal data, in cases were the purposes of such processing can be achieved in this manner.

When you use the app, we may also process certain other electronic data in this regard, such as cookies, identifiers for mobile devices or similar technologies that are used to collect data. They can facilitate the interaction between you as a user and our app and are used in order to improve your user experience and for the collection of statistics among the users. Certain cookies, identifiers or technologies may be placed by a third party, e.g. Firebase, Google Analytics, for measuring the use of our app and/or other features for e.g. authentication, messaging, notifications etc.

5.3. Direct marketing and profiling
5.3.1. If You are an (end) user of the app and/or existing customer of Bavet, Bavet can use your personal data for commercial and advertising communication purposes (direct marketing). Strictly personal communication, greetings and surveys do not in principle constitute direct marketing.

Bavet can send you commercial and advertising messages about Bavet products/services, B-points, your tickets etc. by means of personalised push messages through the app, by email and/or SMS, on certain social networks or other platform for which you have an account.

For the processing of your personal data for direct marketing purposes Bavet relies on its legitimate interests.

However, if you are not and (end) user of the app nor an existing customer of Bavet, your prior consent is required for unsolicited commercial messages and/or processing of your personal data for direct marketing purposes.

If you wish that your personal data is no longer be processed for such commercial and advertising purposes, you have the right to object at any time (unsubscribe or oppose to such processing), free of charge and without assigning any reason (see section 8.3 below). To opt-out you can contact Bavet: app@bavet.eu.

5.3.2. Your personal data (provided directly by you to Bavet and/or transaction data processed via the app) may also be used by Bavet to create user patterns and statistics and to profile you according to your personal characteristics (e.g. gender, age group, vegetarian) in a particular consumer group (profiling).

Bu using such profiling techniques, Bavet is able to send you personalised news, promotions or offers that are tailored to your specific needs and therefore can provide you with added value. The use of these techniques will under no circumstances have legal consequences for you or any other significant consequences.

At any time you have the right to ask for more information of the processing of your personal data for profiling purposes.

You have the right to object at any time, free of charge and without assigning any reason (see section 8.3 below). To opt-out, please contact Bavet: app@bavet.eu. In that case, the processing of your data for profiling purposes shall be ceased immediately.

5.4. The prevention of fraud or other illegal or unlawful use of the app:

We may process your data to block or deny access to the app to you or other users who violate the agreement, our Terms of Use, policies or applicable law and to take action against you or other users.

5.5. We may process your data for other legitimate (commercial) purposes to the extent permitted by applicable law, such as to facilitate our operations and services, generate aggregated statistics, perform market analyses, apply our policies and procedures, defend against claims or demands, protect our users and customers and their rights, and protect the rights of third parties, if any.

5.6. We may process your data for transmission to third parties such as our customers / licensees, partners, service providers, suppliers and / or other contracting parties of Bavet (see also section 6 below) for the implementation of the previous points.

5.7. Compliance with applicable laws:

Finally, we may process your data to comply with applicable laws or lawful requests or orders by supervisory authorities, courts or government agencies.

6. Who has access to your personal data (besides Bavet)?

6.1. Your personal data shall be processed by our partners, service providers or suppliers in connection with making the app available to you, your use of the app and the provision of our services. This includes, e.g., our hosting providers, IT partners, web administrators, network administrators, software suppliers, companies providing payment services, marketing services, communication services or media services to us or other partners or service providers.

Bavet verifies with its processors that they take the necessary appropriate (security) measures in accordance with the GDPR or other applicable privacy legislation to protect your data and concludes the necessary data protection agreements with these processors.

6.2. Your personal data may also be passed on to affiliated companies of Bavet or to Bavet franchisees (if applicable) (e.g. if you have designated your favourite or nearest Bavet restaurant in the app).

6.3. Other companies may also process your data in connection with our services or activities, such as our accountants, auditors, insurance brokers, insurers, legal advisors, lawyers or other service providers.

6.4. Bavet will not disclose your personal data to third parties, except in case of the disclosure of information permitted by applicable law, or referred to in this section 6 or elsewhere in this privacy policy. We are not responsible for the processing of your data by third parties who do not do so on behalf of Bavet, but are responsible themselves.
6.5. Finally, we may be required, by law or following a request by supervisory authorities, courts or government agencies, to disclose your data to them or to a third party.
6.6 . Your data will not be transferred outside the European Economic Area (EEA). If your data would be transferred to countries outside the EEA in respect of which the European Commission has not determined that such countries provide an adequate level of protection for personal data, Bavet will ensure that (additional) measures are taken in accordance with the applicable data protection legislation (e.g. the implementation of standard contractual clauses made available by the European Commission).

7. How long do we retain your data?

7.1. We will not keep, collect or process your data longer than necessary for the purposes as described above in section 5. Without prejudice to the generality of the foregoing, your identification, subscription, electronic, loyalty and/or profile data (see section 4 above) will be kept for as long as you use the app and services of Bavet in connection with which such personal data is processed, unless special legal provisions apply to the storage or processing thereof or longer storage or processing is required to defend our interests in legal proceedings or unless there is any other specific legitimate interest of Bavet in this regard for longer storage or processing.

7.2. The retention period for your personal data may vary depending on the purposes of the processing and our legal obligations. For example, we will keep your data in the context of the performance of our services for a maximum of 10 years after the termination of the (user) agreement with you (this is the limitation period for contractual claims). We will have to keep certain accounting and tax documents (if any), for example, for 7 years. For other certain data, specific statutory retention periods may also apply.

In any case, the general principle always applies that we do not keep your data longer than necessary. If your personal data are no longer required for the purposes intended, we will, if necessary, delete or otherwise anonymise your personal data.

8. What are your rights and how can you exercise them?

8.1. You have the right to information about the processing of your personal data through the app. All necessary information is communicated to you through this privacy statement. You can request us to provide additional information at any time.

8.2. You have the right to request:
– access to your data.

You may obtain one copy of the requested information free of charge. If you request additional copies, we may charge you a reasonable fee as an administrative expense.

– correction of your data (if necessary);

– erasure of your personal (‘right to be forgotten’) data if:
o the processing of such data is no longer necessary for the purpose(s) for which they were processed by us;

o you have withdrawn a previously given consent;

o you object to the processing;

o the personal data would have been unlawfully processed by us;

o this is necessary to comply with a legal obligation; or

o the personal data would have been processed in connection with an offer of online services to children.
– Restriction of processing that relates to you in cases specified in the applicable data protection legislation.
8.3. You have the right to object to the processing of your data.

You can, at any time and free of charge, object to the processing of your data for direct marketing and/or profiling purposes (see section 5.3 above).

This can be simply done by sending us an email (app@bavet.eu).

8.4. You have the right to data portability (transfer of your data to another data controller). This is only possible if the processing by us is based on your consent or the processing is carried out by automated processes.

8.5. If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time.

This will not affect the lawfulness of the processing on the basis of your consent that was granted prior to your withdrawal.

8.6. You also have the right to lodge a complaint with the supervisory authorities, in Belgium the Data Protection Authority (rue du Mail 35, 1000 Brussels – T: +32(0)2 274 48 00 – E: contact@apd-gba.be). In the event of a complaint, you can also contact us (app@bavet.eu).

8.7. The exercise of your rights, as set out above, is always subject to the requirements and conditions set out in the applicable data protection legislation (including the GDPR).

8.8. To exercise your rights, you can simply send us a request at app@bavet.eu. In doing so, you must identify yourself. If we have any reason to doubt your identity, we may ask you for additional information necessary to verify and confirm your identity. Generally, we will request a copy of your identity card in order to verify who is actually making the request. Please ensure that any information or data not required for the verification and confirmation of your identity is blacked out or otherwise removed or rendered illegible.
